GENERAL TERMS AND CONDITIONS

This contract is an online contract with the aim of defining the rights and obligations of parties within the context of the sale of goods offered by Daniel GUITTAT on his website, www.daniel-guittat.fr. www.daniel-guittat.fr

This contract is formed by the following contractual documents:

Definition of client: user of the website, www.daniel-guittat.fr, purchasing a product through this website. www.daniel-guittat.fr qui achète un produit par l’intermédiaire de ce site.

1- Taking an Order

The orders taken through website www.daniel-guittat.fr bind the client from the moment of validation when clicking the "Confirm Order" button, then the "Accept Order and Terms and Conditions" button, located on the purchase order and order summary. www.daniel-guittat.fr engagent le client dès leur validation en appuyant sur les boutons « valider la commande » puis « accepter la commande et les conditions générales » présentés sur le bon de commande et son récapitulatif.

Confirmation email: once the order is confirmed, a confirmation email is automatically sent. By saving this email or printing it, the client retains proof of the order, which we advise them to keep in a safe place.

The contract is deemed concluded from the date this email is sent.

All orders imply that these terms and conditions have been accepted.

2- Availability

Product offers are recommended within available stocks.

3- Delivery Methods and Time

• Delivery is carried out by Daniel GUITTAT and is done exclusively is Paris and the region of Paris.
• Product delivery is carried out at the address indicated by the client when making the order or by a notice of availability, in the case of the client's absence.
• Delivery times are the following: maximum 48 hours.
• In the case where product delivery cannot take place within the agreed time, Daniel GUITTAT will determine a new delivery time to the client. If this new time is not accepted by the client, this will lead to a cancellation of the order and the reimbursement of the corresponding amount by Daniel GUITTAT.
• This reimbursement will made within a maximum of 30 days from the date of the order.

4- Price

• The prices mentioned on the website are valid from the moment of browsing by the client or during an indicated time period.
• The invoiced prices are applicable from the moment the order is made.
• Delivery fees are to be paid for by the client, including VAT and other potential taxes.
• The delivery fee amount is calculated according to the destination and service required. Customs duty, other local or State taxes, or other import duty may apply. These taxes and amounts are not the responsibility of Daniel GUITTAT. They will be paid for by the client and are the full responsibility of the client, in terms of declaration and payment to the authorities.

5- Payment

Le client choisit le moyen de paiement parmi ceux proposés par le marchand dans le site.

En cas de paiement par carte bancaire : Le client doit indiquer son numéro de carte et sa date de validité dans la zone prévue à cet effet sur le bon de commande (saisie sécurisée par cryptage SSL). Cartes acceptées : Carte Bleue, Carte Visa, MasterCard.

6- Transport

The merchandise travels at the client's risk; it is the responsibility of the client to verify the contents of the package upon delivery and to notify the transporter, if necessary, by registered letter or extrajudicial document within 3 days following receipt of the delivered package.

7- Withdrawal Period

The client is granted a period of 7 working days to return, at their expense, for a reimbursement or exchange, the goods (or service) that do not suit them. This period is valid from the date of receipt by the client.

8- Responsibility/Claims

• Daniel GUITTAT is solely responsible for the contents of his offers and engagements undertaken (time periods, descriptions…)
• Daniel GUITTAT is solely authorised to deal with all complaints or disputes regarding the products sold.

10- Proof of Transaction

• In the case of payment by the PAYBOX system, the data recorded by PAYBOX consists as proof of the entirety of the commercial transactions carried out between (name of seller) and their clients.

11- Personal Data

The client has the right to access and rectify any personal data collected in order to process their order, by contacting DANIEL GUITTAT : 68, bd de la Tour Maubourg, 75007 Paris.

12- Applicable Law – Legal Disputes

This contract is subject to French Law.

In the case of a dispute, only French courts shall be deemed competent.
